NEW DELHI: Congress on Friday deemed the Supreme Court judgment on curbs in Jammu & Kashmir as “historic”, saying the verdict not only comes as relief for the 7 million people living there but would act as a deterrent for the government from imposing prohibitory orders and internet ban arbitrarily in any part of India. “This is a very important order. It is a historic verdict that has been pronounced … this will ensure free flow of information from Kashmir. It is historic because the people of India were concerned about the situation in J&K as no one knows about it,” Congress MP Kapil Sibal said. The party welcomed the ruling that prohibitory orders (under Section 144 of CrPC) can only be utilised temporarily and in emergency situations and that any order suspending internet must adhere to the principle of proportionality and must not extend beyond necessary duration. “We want to know from home minister what was the emergency situation on August 4 and 5 on the basis of which Section 144 was imposed across the state? Repetitive orders under Section 144 CrPC would be an abuse of power,” he said citing the Supreme Court order and asserting that government is now duty-bound to put orders relating to all curbs in public domain. The party said its leaders would visit Jammu & Kashmir soon after travel bans are lifted and wondered how foreign envoys were being taken while the government was not allowing even MPs. tnn
