Nirbhaya’s mother Asha Devi expressed anger over stay on death penalty to the convicts and asserted that she would want them to be hanged on January 22

Reacting on the stay of death sentence to convicts in Nirbhaya rape-murder case over mercy petition, the victim’s mother, Asha Devi, termed this as brazen misuse of law and demanded that convicts be hanged on January 22 only.

Talking to India Today, she said, “The delay was by the government, by the jail authorities, why are the convicts getting the benefit of it? Why am I being punished? My daughter died seven years ago and we are still waiting for justice.”

A Delhi court had earlier today put a stay on hanging of the four convicts over the mercy petition filed by one of the four accused.

Staying the hanging, the judge said, “I am not reviewing my order to pass a death warrant. There will be a stay on the execution of the death warrant since a mercy plea is there. Jail authorities just have to give me this report saying we will not hang them on January 22.”

The Delhi government had on Wednesday said that the four convicts, could not be hanged on January 22 as a mercy petition of Mukesh Singh, one among the four convicts was still pending.

The four convicts — Mukesh (32), Vinay Sharma (26), Akshay Kumar Singh (31) and Pawan Gupta (25) – were to be hanged on January 22 at 7 am in Tihar jail. A Delhi court had issued their death warrants on January 7.

Lawyer Seema Kushwaha, appearing for Nirbhaya’s parents argued that the mercy petition is not pending before the President of India. “It has only been filed. We don’t know if it has been sent to the President yet,” she said and added that the hanging cannot be stayed over this petition.

Meanwhile, Delhi government has sent its recommendation to reject the petition . The petition now needs recommendation of the Ministry of Home Affairs.
