According to Live Law, the Chief Justice made the remarks while hearing a petition by suspended Additional Director General of Police Gurjinder Pal Singh of Chhattisgarh. In this, he had sought protection in the criminal cases registered against him.

Gurjinder Pal Singh has been charged with serious charges of sedition, extortion and disproportionate assets. Apart from the Chief Justice, Justice Surya Kant and Justice Hima Kohli were also included in this bench.

During the hearing of the petition, the Chief Justice had said, “It is a very sad situation. When a political party is in power, the police officers are with it. Then after the opposition party comes to power, initiates action against those officials. This is a new trend that needs to be stopped.”

In his remarks, the Chief Justice said that I was once contemplating to set up a standing committee to inquire into complaints against bureaucrats, especially police officers. This panel would be headed by the Chief Justice of the concerned High Court. However, he also said that he wants to keep his idea safe for the time being.

Retired IPS Vibhuti Narayan Rai says on the remarks of the Chief Justice that it is absolutely true that the situation in the country is not good at present.

He says, “Whatever the Chief Justice has commented, he has done it only on the basis of some examples and in such a situation he is completely correct to say that the situation in the country is sad and there is a substantial need for improvement.”

However, Vibhuti Narayan Rai also says that the matter of forming a committee is not new. Many committees have been formed for the improvement of the police department, but the recommendations which the committees send to the governments for implementation, they are not implemented.

He says, “The Chief Justice thought about the formation of the committee, if by doing this reforms happen then it will be good. Also for the police department and also for the country.”

On the remarks of the Chief Justice, we tried to talk to several working police officers. Most of the police officers said that the question of dissent or second thought does not arise on the remarks of the Supreme Court Chief Justice.

Former Uttar Pradesh DGP Prakash Singh says that I completely agree with what the Chief Justice has said about the police officers.

He says, “What the Chief Justice has talked about forming a committee, but in its earlier orders, the Supreme Court, while hearing the petitions, has ordered the formation of committees at the district level, state level to improve the police department. .”

He says that in the year 2006, he himself had filed a petition in this context in the Supreme Court.

He explains that the Supreme Court had given orders for reforms but the orders were not followed at the ground level. The state governments did not implement them properly. Even if some states implemented the orders, they were not followed properly.

He says that in such a situation better than thinking of a new committee, it is better to order the state governments to follow the earlier orders issued for reforms in the police department. At the state and district level, it should be followed effectively.

Prakash Singh speaks of political influence on the police department as well as every department.

He says that police officers and bureaucrats get transferred as governments change, because politicians feel that the police officer who was close during the previous government will no longer be their kin.

Senior Supreme Court lawyer Rebecca John believes that this remark of the Chief Justice of the Supreme Court of India is very serious.

She says that many such cases have come before the Chief Justice, in which there were serious allegations against the police officers and her comment is on this basis.

Rebecca believes that ‘power’ in India is limited to some departments and officers, so accountability should also be fixed. But it is not. That’s why many times, in many cases, police officers, bureaucrats misuse their power. But accountability must be fixed.

And in this context, this remark of the Chief Justice becomes more serious. If there is a committee where, there is an independent inquiry into the complaints against police officers, bureaucrats, then of course accountability will be fixed.

This statement of the Chief Justice has come at a time when fingers are being raised about the alleged arbitrary and barbaric behavior of the police in the country’s most populous state, including the capital of the country.

A case of murder has been registered against six policemen in connection with the suspicious death of Kanpur businessman Manish Gupta at a hotel in Gorakhpur district of Uttar Pradesh.

It was also said in the court that ‘the city is burning, so when will the appropriate time to take action come?’

Human rights activists also raised questions on the police regarding the encounter of four accused in the rape and murder case of a Hyderabad woman doctor.

However, this is not the first time that the Chief Justice has made a scathing remark about the police department.

Earlier in August, Chief Justice of the Supreme Court of India Justice NV Ramanna had said in a statement that police stations are the biggest threat to human rights and human dignity.

The Chief Justice had said that despite constitutional guarantees, incidents of harassment and death in police custody continued.

He had said, “The biggest threat to human rights and human dignity is the police station. If recent reports go by, even the privileged are not able to escape third degree treatment.”

Justice Ramanna had said that legal aid is not immediately available to a person in police custody and the first hours of custody usually decide what will happen to the accused.
